The term stalking derives from the English verb "to stalk" which means "to lurk" and consists in the repeated persecution of one's victim by a stalker, in fact. The victims of stalking report that they have been threatened, waited, stalked and monitored by their tormentor and feel condemned to live in a state of perennial anxiety and fear. In 80% of cases the stalker is a man, often the victim's partner or ex-partner. This harmful conduct can harm the physical but, above all, psychological safety of the "stalker" person, who, as a result, is forced to change their habits of life, giving up freedom of movement and choice.

The crime of stalking was introduced in Italy in February 2009 and provides for a basic penalty from six months to five years of imprisonment, which can increase if the crime is committed by a person with whom the victim entertains or has entertained a affective relationship or is carried out to the detriment of a minor, a pregnant woman or a disabled person.
